Commonly Asked Questions
What happens if I don't have a Will?
Without a Will, the Government will decide how your assets and debts will be distributed through what’s called the probate process. A proper Estate Plan will save your loved ones time and stress by ensuring that your wishes are properly executed.
Are these legally recognized documents?
Of course! All of our documents are custom, legally-valid and designed by attorneys to meet your state’s specifications. As soon as you're finished, we connect you to a verified notary to sign and stamp to make them official.
What is the difference between a Trust and a Will?
A Trust goes into effect immediately after it is funded, while you are still alive. Trusts offer great control over when and how your assets are distributed and allow you to avoid probate. Wills go into effect after your death and allow you to name guardians for your children and pets, designate where your assets will go, and specify your final arrangements.
Does a Will protect me from probate?
A Will alone will not protect you from probate. Any assets that are titled in the decedent’s sole name, not jointly owned, not payable on death, don’t have any beneficiary designations, or are left out of a Living Trust are subject to probate.

Can I really notarize my documents from home?
Absolutely! Our notarization process is completed 100% online through our fully encrypted signing platform. We’ll upload your documents, provide a link to the notary room, and pair you with a verified notary wherever you may be located.
How long does the process take?
Our process is designed to guide you step by step, allowing you to go at your own pace. Most users finish their documents in about 20 minutes. If you're looking to take it slow, our attorney support feature allows you to meet with an attorney to provide line-by-line review of your plan.
Why should I create my estate plan online?
Creating your documents online helps save hundreds in attorney fees and eliminates the need to travel to a law firm. You can do everything right in the comfort of your home while getting the same personalization of a visit to an expensive law firm.
What is probate?
Probate court is the 9-18 month court process of the Government making your Will for you. They will decide where your assets will go, what your loved ones will receive, and even appoint guardianship over your children. This can result in expensive attorney fees and added stress to your loved ones in an already stressful time.
What happens with my information?
At FastWill your security and privacy are number one which is why we use bank-level encryption to protect your data and personal information. FastWill doesn’t sell or share any of your information without your express consent.
